We understand that any unauthorised use of a business’s intellectual property rights can have a damaging effect, as it may cause a likelihood of confusion on the part of the public as to the origin of the goods or services being supplied under the intellectual property or it may be damaging to goodwill.

 

We are experienced in advising clients on the scope of their IP protection and the associated merits of bringing an infringement claim against an infringing third party. We prioritise achieving a commercially beneficial outcome for our clients, and endeavour to assist with settling matters out of court wherever possible, often through the drafting of “cease and desist letters” or “letters before claim” which put the infringing third party on notice of the earlier rights.
